Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") defines the rules and guidelines governing your use of the AIQorex Platform, Products, and Services. It is incorporated into and forms part of the AIQorex Terms of Service. All defined terms in the Terms of Service apply equally here.

By using the Platform, you agree to comply with this AUP. If you do not agree to this AUP, you must not use the Platform.

AIQorex reserves the right to modify this AUP at any time. Material changes will be communicated via email or notice on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the revised AUP.

2. Permitted Use

2.1 Eligible Users

You may use the Platform only if you are at least 18 years old, capable of forming a binding contract under applicable law, and not prohibited from using the Platform under the laws of your jurisdiction.

2.2 Permitted Applications

You may use Products and Services purchased or engaged through the Platform strictly for your own internal business purposes. Permitted uses include:

• Automating internal business processes
• Analysing data within your organisation
• Integrating Products into your own business systems, subject to the licence terms in the Terms of Service
• Engaging Consulting Services for your internal business needs

2.3 Account Use

Each account is for a single individual or entity. Account credentials (login, password, API keys) are personal and non-transferable. You are responsible for all activity occurring under your account.

3. Prohibited Uses

You agree not to use the Platform, Products, or Services for any of the following:

3.1 Illegal, Harmful, or Offensive Activity

• Violating any applicable local, national, or international law or regulation
• Engaging in activity that is fraudulent, deceptive, or misleading
• Promoting or facilitating violence, hate, or discrimination
• Harassing, defaming, or intimidating any person or group
• Publishing or distributing content that is obscene, sexually explicit, or exploitative of minors
• Any activity that could damage, disable, overburden, or impair the Platform or any related infrastructure

3.2 Fraud, Spam, and Malicious Activity

• Sending unsolicited commercial communications (spam) of any kind
• Phishing, smishing, or any form of social engineering
• Distributing malware, viruses, ransomware, or any malicious code
• Using the Platform to facilitate fraud, scams, or financial crimes
• Circumventing or attempting to circumvent any security controls, rate limits, or access restrictions
• Using automated systems (bots, scrapers, crawlers) to access the Platform without prior written consent from AIQorex
• Flooding, packet savour, or any other activity designed to disrupt services

3.3 Intellectual Property Violations

• Uploading or sharing content that infringes the intellectual property rights of any third party
• Using the Platform to distribute pirated software, copyrighted material obtained without authorisation, or any other content that violates applicable IP law
• Attempting to reverse-engineer, decompile, disassemble, or otherwise derive the source code of any Product

3.4 Data and Privacy Violations

• Processing personal data through the Platform in violation of applicable data protection law (including GDPR)
• Collecting, harvesting, or scraping personal data from the Platform without authorisation
• Using the Platform to build databases for resale or distribution to third parties
• Submitting to the Platform any content that contains special categories of personal data (Article 9 GDPR) without explicit legal authorisation and appropriate safeguards

3.5 Competing or Exploiting

• Using Products or Services to build a competing product, marketplace, or service
• Reselling, sublicensing, or redistributing Products to third parties without written permission from AIQorex
• Using Products to provide services to third parties on a commercial basis (including via service bureaus or SaaS)
• Sharing account access or Product licences with third parties outside your organisation
• Using AIQorex's name, branding, or trademarks without prior written permission

3.6 Security and System Abuse

• Attempting to gain unauthorised access to the Platform, other user accounts, or AIQorex's internal systems
• Conducting penetration testing, vulnerability scanning, or security assessments on the Platform without prior written consent
• Using the Platform to attack, infiltrate, or compromise third-party systems
• Configuring Products or Services in a manner that adversely affects other users or the Platform infrastructure
• Mining cryptocurrency or using the Platform for resource-intensive non-business tasks without authorisation

4. AI-Specific Acceptable Use

4.1 Input Content

When using AI-powered Products or Services, you are solely responsible for the content and data you submit as input ("Input"). You represent and warrant that you have the legal right to use all Input provided and that such Input does not violate any applicable law or third-party rights.

4.2 Output Content

AI-generated content ("Output") is generated by automated systems and may be inaccurate, incomplete, or biased. While AIQorex strives to provide high-quality Output, we do not guarantee the accuracy, reliability, or fitness for purpose of any Output. You use Output at your own risk and are responsible for reviewing and validating Output before relying on it in any business decision or public-facing context.

You agree not to use Output:

• In any context where inaccurate information could cause harm (e.g., medical, legal, financial advice without professional oversight)
• To generate content for purposes of spreading misinformation or disinformation
• To impersonate a human being or misrepresent Output as human-generated without disclosure

4.3 Prohibited AI Uses

You may not use AI-powered Products or Services to:

• Train, fine-tune, or improve foundation models without AIQorex's written consent
• Generate content for distribution via channels whose terms prohibit AI-generated content
• Process sensitive personal data through AI systems without appropriate data protection agreements in place

5. Monitoring and Enforcement

5.1 AIQorex's Rights

AIQorex reserves the right to:

• Monitor Platform usage for security purposes, to detect fraud, and to ensure compliance with this AUP
• Investigate any suspected violations of this AUP
• Suspend or terminate accounts, Products, or access immediately and without notice if AIQorex reasonably believes a violation has occurred or that continued access poses a security risk
• Cooperate with law enforcement authorities and third-party rights holders in connection with any investigation of suspected violations

5.2 Enforcement Process

If AIQorex determines that a violation has occurred:

1. First violation: Written warning and, where applicable, immediate suspension of the offending activity
2. Repeated or serious violations: Account suspension for a defined period pending review
3. Severe violations: Immediate and permanent account termination, with refund of unused Subscription fees at AIQorex's discretion

AIQorex reserves the right to take any of the above actions without prior notice where the severity of the violation warrants immediate action.

5.3 Reporting

If you become aware of any activity that violates this AUP, please report it immediately to [email protected]. Include a description of the activity, the account or content involved, and any evidence you have. AIQorex will investigate all reports and take appropriate action.

6. Consequences of AUP Violations

Violation of this AUP may result in:

• Written warnings
• Temporary suspension of your account or access to Products
• Permanent termination of your account and all licences
• Removal of offending content or data
• Civil and/or criminal liability where applicable

You agree to indemnify AIQorex against all claims, damages, and expenses (including legal fees) arising from your violation of this AUP.

7. Third-Party Services

Some Products or integrations made available through the Platform may involve third-party services, tools, or platforms (e.g., OpenAI, Anthropic, Stripe, Calendly, n8n). Your use of those third-party services is governed by their own terms and acceptable use policies. AIQorex is not responsible for the content, availability, or practices of any third-party services.
